1. Introduction

Welcome to Chip Bakehouse! By placing an order on our website, you agree to be bound by these Terms of Service. Please read them carefully. Throughout the site, the terms “we”, “us” and “our” refer to Chip Bakehouse.

2. Our Products (The "Handmade" Disclaimer)

Artisanal Nature: We bake in small batches. Variations in cookie shape, colour, size, and topping distribution will occur. No two cookies are identical; these are handmade imperfections, not defects.

Allergen Warning: Our products are baked in a kitchen that handles gluten, dairy, eggs, soy, peanuts, and tree nuts. While we take extreme care to minimize cross-contamination, we cannot guarantee that any product is strictly free from trace allergens. Customers with severe allergies should not consume our products.

3. Ordering & Acceptance

Offer & Acceptance: Placing an order constitutes an offer to purchase. Our acceptance occurs when we send you a shipping confirmation or a "Ready for Pickup" notification.
Right to Refuse: We reserve the right to refuse or cancel any order for reasons including (but not limited to) ingredient shortages, errors in product description/pricing, or suspicion of fraud. If we cancel your order, a full refund will be issued immediately.

4. Pricing & Payment

Currency: All prices are listed in Australian Dollars (AUD).
Payment: Payment must be received in full before your order is baked. We do not offer "cash on delivery" or "pay on pickup."
Price Fluctuations: Ingredient costs change frequently. We reserve the right to modify our prices at any time without notice. The price charged will be the price listed at the time your order was placed.

5. Shipping, Delivery & Risk

Third-Party Couriers: We use external courier services. Delivery times provided are estimates only. We are not liable for delays caused by the courier network, traffic, or weather events.

Risk of Loss: Responsibility for the products passes to you once the package is delivered to your address or handed to you at pickup.

Authority to Leave: If you provide "Authority to Leave" (safe drop), we are not responsible for theft, damage, or insect/animal contamination that occurs after the package has been delivered.

The "Heat" Clause: We do our best to package securely, but we cannot control the weather. We are not liable for heat damage (e.g., melted chocolate) if a package is left unattended at your property. We highly recommend monitoring your tracking to bring the package inside immediately.

6. Returns, Refunds & Cancellations

Please refer to our Refund Policy for detailed information on cancellations, change-of-mind, and freshness guarantees. This policy is incorporated into these Terms by reference.

7. Intellectual Property

All content on this site (including cookie photos, product names, descriptions, and branding) is the property of Chip Bakehouse. You may not use our images for commercial purposes or claim them as your own without written permission.

8. Limitation of Liability

To the fullest extent permitted by Australian Consumer Law:

Chip Bakehouse shall not be liable for any indirect, incidental, or consequential damages arising from the use or consumption of our products.
Our total liability to you for any claim shall not exceed the total purchase price paid by you for the order in question.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from these Terms or your purchase shall be resolved exclusively in the courts located in NSW.
